Terms of Service & EULA

These Terms of Service ("Terms") and End User License Agreement ("EULA") govern your use of Pointless Streak ("the App"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes on devices you own or control, subject to these Terms and the applicable app store rules (Apple App Store or Google Play Store).

2. Description of Service

Pointless Streak is an entertainment app that tracks a daily streak counter. The App includes:

• A daily check-in mechanic with a 24-hour cycle
• Streak badges earned over time
• A public leaderboard
• In-app purchases to revive a dead streak
• Local push notifications

3. In-App Purchases

• Revive Purchases: The App offers consumable in-app purchases ("Revives") that restore a dead streak. Prices escalate with each use ($0.99, $1.99, $2.99, $3.99, $4.99 cap).
• Consumable Items: Revives are one-time consumable purchases. Once used, they cannot be reused or transferred.
• Payment Processing: All payments are processed by Apple (App Store) or Google (Google Play). We do not process payments directly.
• Refunds: Refund requests must be directed to Apple or Google through their respective refund processes:
  • Apple: reportaproblem.apple.com
  • Google: Google Play refund policy
• No Direct Refunds: We cannot issue refunds directly as all transactions are managed by the respective app stores. Purchases are final upon completion, subject to the app store's refund policies.

4. Restore Purchases

You may restore previously purchased items by tapping "Restore Purchases" in the App. This is useful if you reinstall the App or switch devices. Consumable purchases (Revives) that have already been consumed cannot be restored.

5. User Accounts

• No account registration is required. The App generates an anonymous user ID stored on your device.
• You may optionally set a display name (max 20 characters) that appears on the public leaderboard.
• You are responsible for the appropriateness of your chosen display name. Offensive, misleading, or inappropriate names may be removed without notice.

6. Leaderboard

• The App includes a public leaderboard displaying usernames, streak data, and badge counts.
• By using the App, you consent to your streak data being displayed publicly on the leaderboard.
• We reserve the right to remove any leaderboard entry at our discretion.

7. Prohibited Conduct

You agree not to:

• Manipulate streak data, leaderboard rankings, or badge unlocks through unauthorized means
• Reverse engineer, decompile, or modify the App
• Use the App for any illegal purpose
• Use offensive or inappropriate usernames
• Attempt to interfere with the App's servers or infrastructure

8. Intellectual Property

All content, design, and code in the App are owned by us or our licensors. "Pointless Streak" and "Do Nothing Daily" are our trademarks. You may not use our trademarks without prior written permission.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT DATA (INCLUDING STREAK DATA) WILL BE PRESERVED INDEFINITELY.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO LOSS OF STREAK DATA, LOSS OF PURCHASES, OR INABILITY TO USE THE APP.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR IN-APP PURCHASES IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Termination

We may terminate or suspend your access to the App at any time, without notice, for conduct that violates these Terms. You may stop using the App at any time by deleting it from your device.

12. Changes to Terms

We may update these Terms. Continued use of the App after changes constitutes acceptance of the updated Terms. Material changes will be communicated through the App or on our website.

13. Governing Law

These Terms are governed by the laws applicable in your jurisdiction. For EU users, nothing in these Terms affects your statutory consumer rights under EU law.

14. Apple-Specific Terms

If you downloaded the App from the Apple App Store:

• This EULA is between you and us, not Apple. Apple has no obligation to provide maintenance or support.
• Apple is not responsible for any product warranties, whether express or implied.
• Apple is not responsible for addressing any claims relating to the App.
• Apple is a third-party beneficiary of this EULA and may enforce it against you.

15. Google Play-Specific Terms

If you downloaded the App from Google Play:

• You acknowledge that Google has no obligation or liability with respect to the App.
• Google Play's Terms of Service also apply to your use of the App.
